The property in question is located in the industrial area of "Latina scalo".
The complex consists of a main building with a covered area of 5,211 sqm, and two smaller buildings for electrical cabins with a covered area of 48.08 sqm and in the lot of exclusive property of 22,341 sqm.
The real estate complex consists of a two-story industrial building with an attached large courtyard area, a porter’s lodge, two electrical cabins, two detached and independent warehouse buildings from the main one, and perimeter canopies adjacent to the main building.
The establishment is accessible from via Carrara through a driveway registered to third parties.
The main industrial building, identified in the CF with sub. 1 and 2, consists of a prefabricated concrete structure with a rectangular plan measuring 115.8 m in length and 45.0 m in width, and is mainly composed of the production department, offices and warehouses, a cafeteria, and changing rooms for the operators, as well as the residence of the owner/custodian:
1. The production department has a usable area of 4,442.16 sqm, extends for a length of 99.5 m, has a height of 8.35 m, and has transverse frames with two spans of 22.0 m of light;
2. The office and warehouse departments have a usable area of 835.82 sqm, extend for a length of 16.3 m in continuity with the production department, have an internal height of 3.0 m, are developed on the ground and first floors, and are divided by a single-ramp staircase;
3. The changing rooms and cafeteria have a usable area of about 71.0 sqm, an internal height of 3.0 m, and are developed on the ground floor adjacent to the production department;
4. The residence has a usable area of 117.37 sqm and is located on the first floor with an internal height of 3.0 m. It consists of an entrance, a kitchen, a storage room, two bedrooms, and a bathroom. The residence is completed by a covered terrace of 41.25 sqm.
There is a right of way on the access avenue to the activity, from the public road, as the property referred to in sheet 92, parcel 305 is registered to the Industrial Consortium, along with parcels 187, 303, and 304 that make up the lot pertaining to the building.
There are discrepancies in the land registry and urban planning.
Please note the following:
- the CONSIND Lazio, Industrial Agglomeration Latina Scalo with protocol Consind Lazio 2023 – 0011007 of 15/11/2023, has communicated pursuant to art. 7 L. 241/90, the start of the site conversion procedure pursuant to art. 63 L. 448/1998 on resolution no. 265 of 7.11.2023 verbal no.12;
- that the Bankruptcy Administration has filed a jurisdictional appeal to the Regional Administrative Court for Lazio, Detached Section of Latina, currently pending with no. 23/2024, for the annulment and/or reform with a declaration of nullity/ineffectiveness;
- That the property referred to in sheet 92 parcels 583 and 310 in the land registry of the Municipality of Latina, and in the building registry of the same Municipality sheet 92 parcels 583, subb. 1, 2, 6, 7 plus two properties b. c. n. c. of which subb. 3 and 5 have been granted in precarious lease for two years starting from 18/04/2024 until 17/04/2026, by means of a contract registered on 9/5/2024, in which among other things, in art. 12, recalled and again signed at the bottom by the tenant pursuant to art. 1341 cc it is specified that the administration has the right of withdrawal even in case of sale and/or to third parties, and that the tenant has undertaken to vacate the properties free of persons and things, within 90 days from the exercise of the right by the administration, or from the sale, without the need to present a warning and without any reservation and/or right of retention and/or compensation being opposed.
